Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the websites, applications, content, products, and services offered by TripForge, LLC (“TripForge,” “we,” “our,” or “us”) that link to or reference these Terms (collectively, the “Services”), including TripForge trip planning, EventForge event itineraries, ForgePrint travel profiles, and any features for user-generated or geo-tagged photos and other content. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Who We Are

TripForge provides AI-assisted trip and event planning tools and related features that help users explore destinations, organize preferences, create itineraries, and, where enabled, save long-term travel profiles (such as ForgePrint) and share geo-tagged photos or other content. TripForge is not a travel agency or a booking provider. We do not control third-party travel providers, their prices, availability, or policies.

2) Eligibility and Accounts

• You must be at least 16 years old to use the Services.
• Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You agree to provide accurate information and to promptly update it. We may suspend or terminate your access if we believe you violated these Terms or applicable law.

3) Permitted Use and Prohibited Activities

You may use the Services only in compliance with these Terms and applicable law.

You agree not to:

• Scrape, crawl, index, or collect data from the Services without prior written permission.
• Copy, modify, distribute, or create derivative works from the Services or content therein.
• Reverse engineer, decompile, or attempt to extract source code or underlying models.
• Bypass access controls, rate limits, or security features (including bot protection/Turnstile).
• Use the Services to post or transmit malicious code, spam, or unlawful content.
• Use the Services in a way that infringes or violates the rights of others, including privacy, publicity, and intellectual property rights.
• Upload, post, or share User Content (including photos or videos) that is illegal, defamatory, obscene, hateful, harassing, sexually explicit, exploits or endangers children, or otherwise objectionable.
• Upload photos or other content that reveal personal information about another person without their permission, including sensitive or private locations, or that were taken in violation of applicable law or venue rules.

4) User Content and License

You may input trip and event parameters, save itineraries, create profiles (including ForgePrint or similar travel DNA profiles), and, where enabled, upload photos, reviews, ratings, comments, and other materials (“User Content”). You retain ownership of your User Content.

By submitting, uploading, or storing User Content in or through the Services, you grant TripForge a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, reproduce, adapt, modify (for formatting or technical purposes), translate, and display your User Content as reasonably necessary to operate, maintain, provide, protect, and improve the Services, to develop new features, and as otherwise described in our Privacy Policy.

If you choose to submit User Content to public or community-facing parts of the Services (for example, geo-tagged photos tied to locations, reviews, or other content that we mark as public), you also grant TripForge a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that User Content to other users and the public in connection with the Services (including on maps, venue pages, example itineraries, marketing pages, or social media channels operated by TripForge). We will not sell your User Content to third parties, but we may use it in anonymized or aggregated form to help illustrate or improve recommendations.

You are responsible for your User Content and represent and warrant that you have all necessary rights to submit it and grant the licenses above; that your User Content does not violate these Terms or applicable law; and that, where your User Content includes other people (for example, in photos), you have obtained any required permissions.

We reserve the right (but have no obligation) to remove or disable access to any User Content that we believe violates these Terms, our policies, or applicable law.

If you choose to generate a shareable link to a trip, event, or other content, anyone with that link may view the content. You are responsible for how you share that link.

5) Intellectual Property

The Services, including all software, text, images, logos, trademarks, and other materials, are owned by TripForge or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not use TripForge marks without our prior written permission.

6) AI-Generated Content – Important Disclaimers

TripForge uses artificial intelligence to generate itineraries and recommendations. AI outputs may contain errors, be incomplete, reflect outdated information, or rely on third-party data. You must independently verify critical details (e.g., prices, hours, locations, safety, entry requirements, cancellation policies) before booking or traveling. TripForge does not guarantee the accuracy, completeness, or reliability of any AI-generated content.

7) Third-Party Services, Links, and Affiliates

The Services may link to or integrate with third-party websites, apps, APIs, or services (including mapping/places providers, booking partners, analytics tools, media hosting providers, and email delivery platforms). Your use of third-party services is governed by their terms and privacy policies. TripForge is not responsible for third-party content, availability, performance, or policies.

We may include affiliate links to booking partners. We are not a party to your transactions with third parties and have no responsibility for reservations, payments, customer service, or disputes with those providers.

8) Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share information, including ForgePrint/profile data and user-generated or geo-tagged content. Please review it carefully.

9) Warranty Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPFORGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPFORGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID TO TRIPFORGE (IF ANY) IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS LESS.

11) Indemnification

You agree to indemnify, defend, and hold harmless TripForge and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content (including any ForgePrint data or geo-tagged photos); or (c) your violation of these Terms or applicable law.

12) Modifications and Termination

We may modify the Services or these Terms at any time. If we make material changes, we will provide notice (e.g., by updating the Effective Date, posting a notice on the site, or sending an email). Your continued use of the Services after changes take effect constitutes acceptance. We may suspend or terminate your access at any time, including if we believe you violated these Terms.

13) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Colorado, U.S.A., without regard to conflict of laws principles. Binding arbitration and class action waiver: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis in Denver, Colorado, administered by a reputable arbitration provider under its rules. YOU AND TRIPFORGE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. This section does not prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect its rights pending arbitration.

14) Export and Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any country or entity subject to U.S. embargoes or sanctions and that you will not use the Services in violation of export control or sanctions laws.

15) Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, User Agreement, Affiliate Disclosure, and any other posted policies or guidelines, form the entire agreement between you and TripForge regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
• Headings: Headings are for convenience only and have no legal effect.
